Privacy By Design: What it is (And How it is Evolving)
Abstract
The digitalisation of society has led to growing calls, particularly during the past two decades, for a more proactive response from regulators and industry in safeguarding the privacy of individuals. These calls are unlikely to disappear as businesses discover new opportunities for data collection and information sharing. Many now see the “Privacy by Design” strategy as enabling privacy considerations to be embedded ex ante; accordingly, technological safeguards may help overcome some of the actual or perceived shortcomings in current regulatory compliance culture. In the light of the UK Information Commissioner’s adoption of a “Privacy by Design” strategy, this paper explores a number of key issues that arise – not least the policy implications of the barriers that presently exist in relation to industry’s attitude towards the strategy. I suggest that in the long term, the emergence of a sustainable privacy ecosystem may also require the re-alignment of the “Privacy by Design” model with other privacy generative models involving consumers and end users. It may very well be that as we move towards this goal, the meanings we attach to privacy in the virtual and real spaces may evolve.
