Abstract
Ensuring privacy in the emergent ubiquitous information society requires a careful identification of its specific challenges. Far from being confined to the effects of the widespread popularity of web 2.0-like services, constantly increasing digitalisation, or intensive data mining and profiling practices, these challenges are actually triggered by the confluence of all these phenomena with the advent of the ‘Internet of Things’. The new realities oblige us to question different aspects of the legal development of the right to data protection, especially regarding its practical implementation. Most notably, however, they appear to call for a re-focusing the development of the fundamental right to privacy in EU policy and legal instruments, away from its current focus on the protection of personal data and towards a combination of multi-layered perspectives. The presentation will advance concrete paths for the development of such a combined approach for the effective protection of our private lives, homes and communications, in the context of the realisation of a trustworthy information society.
