Short BIO
Pascale Gelly is an attorney at the head of the Paris based Cabinet Gelly with an extensive practice of emerging and international data protection issues, both in house with GE and as an outside counsel.
Pascale is one of the authors of the model clauses approved by the EC Commission in 2004 and of GE’s BCR. She has been playing an active lobbying role in Europe on other matters as well, such as e-mail marketing, employment data, whistleblowing lines and simplification of notifications.
She holds a post-master degree (University Paris II) and an LLM (Columbia Law School- New York).
Pascale is board member of AFCDP (French Association of Privacy Correspondents) in charge of International Affairs and a member of the European Advisory Board of IAPP (International Association of Privacy Professionals). She has also recently joined the scientific committee of EPA.

Abstract
Lawyers working on data privacy in France are busier and busier. With the CNIL President presiding as well the G29 an important focus is on international data transfers including the BCR solution. Setting up a whistleblowing system is part of the usual legal work. “Emerging” recurring topics revolve around behavioural advertising, e-discovery proceedings, biometrics and data retention. DPA on site investigation activity is also getting more intense, which require data protection lawyers to put on a litigator hat.
